Whether you are going through a divorce or you are an unmarried parent, you always want the best for your children. One of the most challenging issues divorced or separated parents must deal with is making child custody and visitation arrangements. When awarding child visitation, the court almost always bases the decision on the child’s or children’s best interest which include but are not limited to; a child’s gender, their age, grade level, physical/emotional health, the mother’s and father’s lifestyle, the parent’s financial standing, debt and ability to provide for the child, established emotional ties between either of the parents, how stable each of the living situations seem to be, the quality of the school districts and sometimes based on the child’s wishes as long as they are above the age of 12 years old. Once whichever parent has been deemed the one with custody, child visitation rights permit the parent that does not have physical child custody, to spend time with their child or children. Visitation “time schedules” can be structured or set by the court as part of the custody agreement or left for the parents to agree upon. Once the schedule is made and agreed upon in the court, any changes have to be documented and submitted to the court.

If the parent with custody interferes with the schedule at all, the parent that does not have the custody may want to seek other ways to continue the relationship and non-payment of child support may be an issue for a change in the child visitation schedule or agreement.
